On Monday, March 23, 2009 the San Francisco Daily Journal published Hybrid Warranty Suit Runs Out of Gas, written by CBM Attorneys Sean P. Conboy and Joseph A. Kaufman. In the article, Mr. Conboy and Mr. Kaufman discuss Paduano v. American Honda Motor Company Inc., 169 Cal.App.4th 1453 (2009) where California’s 4th District Court of Appeal recently applied a federal pre-emption analysis to the question of whether hybrid drivers are permitted to sue automobile manufacturers for false advertising or breach of warranty if a hybrid vehicle proves less fuel efficient than the MPG estimate on its window sticker claims. The article discusses the court’s ruling and concludes that it will prevent the otherwise inevitable flood of lemon law suits alleging inaccurate fuel efficiency estimates for hybrid and alternative fuel vehicles, but may also pave the way for an increased number of false advertising claims. » Read Article
