Mr. Miller has substantial experience handling commercial litigation, construction litigation, products liability, premises liability, professional liability, and intellectual property matters. Recently, Mr. Miller successfully defended clients in two product liability trials and secured a multimillion-dollar settlement mid-trial on behalf of a plaintiff suing for breach of a real estate joint venture. He has also participated in a number of professional liability trials, each of which resulted in jury defense verdicts.

Commercial and Business Litigation

• Mr. Miller obtained a multimillion-dollar judgment for an investor alleging fraudulent investment scheme.
• He obtained a multimillion-dollar settlement, including attorneys’ fees, only weeks after filing a lawsuit alleging fraudulent operation of a hedge fund and breach of the fund’s offering memorandum.
• He represented a homebuilder alleging violation of filed tariffs by public utility.
• He has successfully represented numerous companies in defense and prosecution of breach of contract actions and litigation alleging various business torts, including interference with prospective economic advantage and unfair business practices.

Trade Secret Litigation

• Mr. Miller obtained a pretrial multimillion-dollar settlement on behalf of a construction and engineering corporation alleging trade secret misappropriation and employee raiding.

Real Estate Litigation

• Mr. Miller obtained a mid-trial, multimillion-dollar settlement on behalf of a plaintiff alleging breach of a real estate joint venture.
• He triggered a multimillion-dollar settlement in favor of plantiff hotel development joint venturer almost immediately after providing defendants with the draft complaint alleging fraudulent inducement into the joint venture.
• He successfully litigated a homeowners’ association allegations of violations of CC&Rs.

Construction Litigation

• Mr. Miller obtained summary judgment for a large general contractor in a construction worker’s catastrophic personal injury action alleging unsafe work conditions and failure to supervise.
• He obtained a favorable settlement on behalf of a major engineering corporation in a breach of contract claim against a quasi-governmental entity.
• He obtained a dismissal with prejudice for a framing and foundation contractor in litigation involving catastrophic personal injuries and in which all other parties settled for policy limits.
• He has represented various contractors in alleged construction defect actions.

Professional Liability Litigation

• Mr. Miller represented more than 75 physicians and physician groups in defense of professional liability lawsuits.

Products Liability

• Mr. Miller obtained a defense judgment for a manufacturing company following a two-week federal bench trial in which plaintiff alleged design and manufacturing defects of a fiberglass and steel chair.
• He has represented manufacturers of school equipment, forklifts, industrial press brakes, firearms and airplanes.
• Mr. Miller has successfully defended lead paint litigation (Proposition 65).
