Mr. Binion handles complex commercial cases in state and federal court, as well as domestic and international arbitration. Mr. Binion’s recent work has focused on insurance coverage issues arising in first- and third-party insurance contexts. He has litigated and counseled clients on coverage issues relating to mass torts, environmental claims, medical monitoring, emerging technologies, directors and officers professional liability, property damage and title, and Medicare reporting and reimbursement issues. He also monitors developments in emerging coverage issues. He also monitors developments in emerging coverage issues, including issues related to Medicare and emerging technologies, such as nanotechnology.
As an integral part of his practice, Mr. Binion provides advice and analysis to policyholder and insurer clients to resolve issues without litigation if possible. If litigation is required, Mr. Binion's pre-litigation analyses prepare clients to tackle litigation in an issue-focused and cost-effective manner. Mr. Binion's analyses and strategies have resulted in savings of millions of dollars to clients.
Commercial and Business Litigation
Mr. Binion has handled a variety of litigation matters, including matters in state and federal court as well as domestic and international arbitration, and is experienced in pretrial preparation and trial practice in complex disputes. In addition to complex coverage litigation, he has litigated ERISA, ADA, class action and unfair business practice cases.
