Ms. Harvilla is a litigation associate with experience in state and federal courts throughout the United States. She has represented clients in a wide variety of complex commercial litigation matters including contract disputes, antitrust, intellectual property, fraud, civil rights issues, and insurance and reinsurance litigation and arbitration.
Ms. Harvilla has also represented a national pool of insurers in litigation against another multinational insurance company over the under-reporting of that insurer's worker's compensation premiums. Through this and her other work, Ms. Harvilla has gained substantial experience in law and motion practice and all stages of discovery, and has lead teams of attorneys through large discovery efforts.
Intellectual Property
Ms. Harvilla has represented a generic drug manufacturer in asserting claims against a brand company arising out of the brand company's efforts to prevent market entry and to undermine the generic's 180-day exclusivity period. In that case, her efforts focused on defining the relevant market for purposes of asserting antitrust counterclaims, proving the brand company's clinical drug trials were misused to improperly promote a line extension, and that the brand company had improperly interfered withe the generic company's Paragraph IV certification under the Hatch-Waxman Act.
